Privacy Policy

This Privacy Policy describes the policies of Black Badger Enterprises LLC, 1221 Turner St, STE 206, Clearwater, Florida 33756, United States of America, email: info@blackbadger.biz, phone: 727-306-3202, on the collection, use and disclosure of your information that we collect when you use our website (https://blackbadger.biz) (the "Service"). By accessing or using the Service, you are consenting to the collection, use and disclosure of your information in accordance with this Privacy Policy. If you do not consent to the same, please do not access or use the Service.

We may modify this Privacy Policy at any time without any prior notice to you and will post the revised Privacy Policy on the Service. The revised Policy will be effective 180 days from when the revised Policy is posted in the Service and your continued access or use of the Service after such time will constitute your acceptance of the revised Privacy Policy. We therefore recommend that you periodically review this page.

Information we collect

We will collect and process the following personal information about you:

  • Name
  • Email
  • Mobile
  • Work address

What this website itself collects

What you send us. If you fill in a form on this site, we receive what you typed, which page you sent it from, how you first found the site (the first page you opened, the site that sent you and any campaign tags on the link), and the technical details of the request such as your IP address and browser. That goes into our own client system so we can reply, and it triggers a notification to us and a confirmation to you. We do not add you to a newsletter or a drip sequence for having contacted us.

How visitors use the site. We built our own analytics into this site rather than using a third-party product, so no analytics company receives a record of your visits. It records the pages you view, how long you stay, how far you scroll, where on a page you click and the words on what you clicked, where a mouse pointer rests, which form fields you use and for how long, whether a form was sent or a call booked, your type of device, browser and operating system, and your approximate location worked out from your IP address. It never records what you type into a form, your keystrokes, or anything on our editor pages.

The visitor cookie. A first-party cookie holding a random identifier lets us recognize a returning visitor across days. On your first visit a notice asks you to choose OK or No thanks. In the EU, the rest of the EEA, the UK and Switzerland the cookie is set only after you click OK. Elsewhere it is set from your first page view unless you click No thanks. Without it, or after No thanks, or when your browser sends Global Privacy Control, your visits are counted anonymously. Our server works out a short identifier from your IP address, your browser details and a secret only we hold, and changes it every day, so it cannot follow you across days or to other sites.

Linking a form to your visits. If you have the visitor cookie and send a form, your visits, earlier and later, are linked to the name, email and company you sent, so we can see which pages brought you to us. Without the cookie, the form is not linked to your visits.

Session replays. With your OK, and only then, we may record a visit as a replay of the pages you saw, your scrolling, your pointer and your clicks. Every form field is masked, keystrokes are never captured, and embedded content such as the booking calendar is left out.

Our Cookie Policy lists every cookie, what it is for and how long it lasts.

How we use your information

We will use the information that we collect about you for the following purposes:

  • Replying to you and discussing the work you contacted us about
  • Support for clients we are working with
  • Administration and service information
  • Enforcing our Terms of Service
  • Protecting the site from abuse
  • Understanding how visitors find and use this site, so we can improve it

We do not run advertising and we do not use your information for ad targeting.

If we want to use your information for any other purpose, we will ask you for consent and will use your information only on receiving your consent and then, only for the purpose(s) for which you grant consent unless we are required to do otherwise by law. SMS opt-in and phone numbers collected for SMS communication purposes will not be shared with any third party and affiliates for marketing purposes.

How we share your information

We will not transfer your personal information to any third party without seeking your consent, except in limited circumstances as described below:

  • Vercel, which hosts this site, sees your IP address to serve each page and tells us your approximate location
  • Supabase, which stores this site's data (including the analytics described above and what forms send) and runs our internal systems
  • Resend, our email provider, to deliver the notification and confirmation messages described above
  • Calendly, if you choose to book a call through the scheduler on our contact page, and only what you give them directly
  • Cloudflare, whose Turnstile check runs on the forms on this site and sees your IP address and browser details so it can tell a person from a program

Each of them processes it on our instructions to run this site and our internal systems.

We do not use a third-party advertising service, and we do not send your information to a third-party analytics product. Our analytics are our own and are described above.

We require such third parties to use the personal information we transfer to them only for the purpose for which it was transferred and not to retain it for longer than is required for fulfilling the said purpose.

We may also disclose your personal information for the following: (1) to comply with applicable law, regulation, court order or other legal process; (2) to enforce your agreements with us, including this Privacy Policy; or (3) to respond to claims that your use of the Service violates any third-party rights. If the Service or our company is merged or acquired with another company, your information will be one of the assets that is transferred to the new owner.

Retention of your information

This site has no user accounts. The analytics described above, including our analytics copy of what forms send, are deleted after 13 months. A visitor record is kept until 13 months after that visitor's last visit, but the name, email and company on it go 13 months after the form that gave them. Session replays are deleted after 90 days. What you send us through a form is kept in our client system for as long as we need it to fulfill the purposes for which it was collected as detailed in this Privacy Policy. We may need to retain certain information for longer periods such as record-keeping / reporting in accordance with applicable law or for other legitimate reasons like enforcement of legal rights, fraud prevention, etc. Residual anonymous information and aggregate information, neither of which identifies you (directly or indirectly), may be stored indefinitely.

Your rights

Depending on the law that applies, you may have a right to access and rectify or erase your personal data or receive a copy of your personal data, restrict or object to the active processing of your data, ask us to share (port) your personal information to another entity, withdraw any consent you provided to us to process your data, a right to lodge a complaint with a statutory authority and such other rights as may be relevant under applicable laws. To exercise these rights, you can write to us at info@blackbadger.biz. We will respond to your request in accordance with applicable law.

To say no to the visitor cookie and to replays, click No thanks on the cookie notice, or use Cookie settings at the foot of any page to change your answer at any time. We treat a browser that sends Global Privacy Control as having said No thanks, unless you click OK yourself. After No thanks we delete the visitor cookie and the profile it had built, such as the first page you saw and your city, and count your visits anonymously.

We do not profile you for marketing. If you have written to us through the contact form and would rather not hear from us again, say so at info@blackbadger.biz and we will stop.

Do note that if you do not allow us to collect or process the required personal information or withdraw the consent to process the same for the required purposes, you may not be able to access or use the services for which your information was sought.

Security

The security of your information is important to us and we will use reasonable security measures to prevent the loss, misuse or unauthorized alteration of your information under our control. However, given the inherent risks, we cannot guarantee absolute security and consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

Third party links and use of your information

Our Service may contain links to other websites that are not operated by us. This Privacy Policy does not address the privacy policy and other practices of any third parties, including any third party operating any website or service that may be accessible via a link on the Service. We strongly advise you to review the privacy policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
